No £18,600 visa requirement.Approve applications in appeal, refused soley for not meeting it.

Reduce the £18,600 UK visa requirement. Approve those applications that are in the appeal process which were soley refused for not meeting this requirement. Like many who DO MEET THIS REQUIREMENT but were still refused due to methods used by the UKBA when calculating income.

Why is this important?

On 9th July 2012, the government introduced rules which set an income threshold so high that 47% of British people could not live with their spouse, if their spouse came from outside the EEA. They did this without a proper debate in Parliament; they introduced this through secondary legislation. When challenged by the courts, a perfunctory debate was held in the Lords. Harsh, draconian rules which... divide the families of British citizens were introduced without the knowledge of most people, or even many parliamentarians, in this country.

These rules are an attack on the rights of migrant communities. But they are also an attack on British citizens' rights. The right to fall in love, to marry and settle with whom you choose. The right of children to be with their parents, the right of people to be with their loved ones. Maybe more important than rights, they represent an attack on our values; the value of family, the value of marriage, the value of childhood itself. This is an attack on British citizens on the basis of income maybe unprecendented since the era of the workhouse. It must be challenged.

This is affecting thousands of families, some have no hope of even applying with these rules in place, others who do meet this requirement are still being refused due to the methods used by UKBA when callculating income. This is what happend to me and my husband, I earn't above the required £18,600 but we were still refused our visa based on the ECO calculating my income incorrectly with not looking at evidence provided. I am now so stressed due to the situation that I am unable to do my job. This is costing the UK not benefiting our country. This is having a negative effect on people's mental and emotional health, seperating families and forcing people to live apart from there spouse or child/children. Someone who is from outside the EU is not entitled to any benefits, we are not asking for any handouts or financial help. I am a British citizen who feels that I have no rights in my own country.

My husband and I met in 2007, we married in 2010. We were rufused our visa on the grounds that I did not meet the financial requirement, YET my salay was in excess of the required amount but due to method...s... used by the ukba they calculated my pay incorrectly with not looking at evidence provided.
If they lower the requirement then those applications refused soley for not meeting this requirement and in appeal should be granted there visa. If they lower the requirement and those who were refused for not meeting it, appealed but lost should also be granted there visa. We should not be forced to re apply and kept apart from our loved ones for more months/years and we shouldn't have to pay another £1000 +
