Protect our Human Rights to peacefully enjoy our home and family life

Why is this important?

We are retired grandparents with three generations living together in our home. We have worked hard to take care of our family and live on a Royal Mail pension.

We bought our home in a quiet, green, residential area of London, 31 years ago and did not expect to have our peaceful, family life destroyed by places of worship appearing next door.

We are of the same faith as the centres and our problem is not about race or religion. It is about our right to peacefully enjoy our home with our family and that the State has neglected its obligations to us.

The Local Planning Authority has allowed, by acts and omissions, for three Places of Worship, Properties A, B and D, to operate directly next door to our home ā€“ Property C.

The Local Planning Authority granted planning permission for residential homes A and B to operate as Places of Worship, next door to us, in a residential area, contrary to planning policies. The Local Planning Authority did not enforce conditions regarding planning permissions on Properties A and B. The Local Planning Authority omitted to enforce the illegal operation of Property D as a Place of Worship for 6 years and did not object to permission being granted at appeal.

The State has incorrectly granted permissions; omitted to enforce; failed to enforce effectively; and neglected to recommend appropriate sites in non-residential areas for a Place of Worship. In doing so, the State has permitted Places of Worship to operate next to our home without any regard for our Human Rights to live peacefully and enjoy our family life and home.

The successive failures of the Local Authority have created this situation. We are currently awaiting a decision by the Inspectorate of Planning regarding change of use of Property D to a Place of Worship.

If granted permission, this would be the third property next to our home to be granted change of use to a Place of Worship. The State would again be in breach of our Human Rights, Article 1, First Protocol to peacefully enjoy our home without State interference and Article 8 to protect our privacy and right to a private and family life.

Please protect our Human Rights, protect our family and stop Property D being granted change of use to a Place of Worship.

We WON our Judicial Review and Statutory Review!!

The High Court Order has found the Inspector for the Secretary of State, made an ERROR in LAW in his decision.

The Inspector's decision to grant permission for 852 Harrow Road to operate as a Place of Worship has been QUASHED.

Brent Council's Enforcement Notice is REINSTATED.

852 Harrow Road CANNOT legally operate as a Place of Worship.

Dear Supporters,

Wishing everyone a Happy 2019, may it bring us all peace and unity!

A lot has happened since our last post 2 months ago and we would like to share with you.

When the Secretary of State decided to sandwich our home between two Mosques in November 2018, we were devasted. We are practising Muslims and this is not about religion. It's just not fair to place Community Centres and Places of Worship next to any home.

We made the decision that we had to take legal action against the Secretary of State and filed a Judicial Review in the High Court. The Judical Review challenges the decision made by the Secretary of State to sandwich our home between two Mosques.

We are currently waiting for the Secretary of State to reply to the Court.

Thank you wonderful people for helping us protect our parents' Human Rights to peacefully enjoy their family life in their own home.

The Secretary of State has granted permission for the homes immediately next to us to operate as Places of Worship, which is against current planning policies.

Places of Worship are supposed to be in Town Centres to avoid disruption to residential areas. The State by making an error in this decision, has neglected their obligation to protect our Human Rights to peacefully enjoy our family life in our home, without State interference.

Please help us to defend our Human Rights and together make the Secretary of State reverse its unfair decision.

Decision Made ā€“ 28 days to overturn Decision and achieve a WIN / WIN outcome

To all the kind people who have taken the time to sign our petition and the wonderful souls considering it, the Inspectorate of Planning has disregarded our Human Rights and granted permission for Property D to operate as a Place of Worship. This decision by the State is against all current planning policies and is an attempt to avoid bad publicity regarding ethnicity, faith and religion. The State has an obligation to help Community Groups find appropriate sites for Places of Worship in Town Centres. They have NOT done this. We request the Secretary of State, James Brokenshire, to Recover Jurisdiction and overturn this decision before the deadline of 28 days, which is 28 November 2018. We want this Community to have a suitable place to worship in a Town Centre and to have families next door. Please sign this petition and help us all to live in peace and harmony.
