Family failed to convince the judge of their need to stay in the home DESPITE psychological assessments saying all three had 'hoarding disorder' and youngest had autism and suicidal tendencies if routine interrupted. I pleaded with them concerning them having nowhere to go. WVHT has offered no other accommodation or help. They have SIX WEEKS to get out of the home they have been in for 50+ years...the one their mother was ONE WEEK AWAY FROM BUYING when they evicted her and she died. I am not sure what to do now. Justice in this country seems skewed to me. Any suggestions - please message me. We have been running around trying to get a solicitor who specialises in evictions PLUS RIGHT TO BUY interruptions. Looking through the extensive paperwork I see poor 87yr old May enquired about the right to buy her property in November 2014. The receipt of her full application was acknowledged in March 2015. The RTB 2 in which 'the Trust admitted your right to buy' and an acknowledgement of the valuation of the property was accepted at the beginning of June 2015. The solicitors were ready for completion on the right to buy. On 16th June 2015, 10 days before completion Weaver Vale Housing Trust started eviction proceedings. You see, all that can stop you buying a house from the council or housing trust is a pending eviction order.
We have hit a real problem concerning the upcoming court case when Weaver Vale Housing Trust are hoping to evict May Appleton's 3 sons. The court case initial hearing is early June, with the main hearing being the 7th & 8th of July. Two weeks ago the solicitor dealing with their case left the firm.
The next stop on this journey is to further prevent WVHT from evicting this family they have hounded for so long. This will happen in June at Chester Crown Court. The sons have had psychological assessments to prove that their hoarding is an illness. I will update as soon as the date is known.
Sadly, this is still not what the sons need as it is not a hearing to allow them to buy their home BUT to prevent them evicting. The sons continue to pay FULL rent and WVHT have continued to refuse to allow them to be tenants (they are known as trespassers) and refused to do any repairs to the house. Basically, WVHT are refusing them any basic tenant rights.
We are STILL fighting for May's right to buy to be transferred to the sons. WVHT have come up with many excuses why this is not possible just like they did when May was still alive. May lived in the house for 67 years and never missed paying her rent. STILL FIGHTING - PLEASE KEEP SIGNING AND SHARING!
YAY! we managed to get an last minute adjournment after much stress and pestering. Therefore, the court date of 22nd December is cancelled. I will let you know when the new date is. May's sons are so happy just to have a peaceful Christmas. This court date was definitely just to try and get them evicted. My purpose is to force WVHT to look again at their right-to-buy. I have had a few legal people saying that May lost her right to buy the previous council owned home when WVHT took over. WVHT are taking the Appleton sons to court on 22nd December to try to get an eviction order. If this is achieved, the whole story will go on as many media outlets as possible. Please message if you want more information. We have held off the media coverage until after this date. THANKS.
Weaver Vale Housing Trust have requested an inspection of the house this week to see if anything has changed. It hasn't. The youngest son, who has autism, is desperately screaming out if anyone mentions moving any of his mother's things. He is saying he can't bear the thought of the first Christmas without his mum. He is scared that if WVHT come into their home again, they will be evicted again. His brothers are afraid to tell him that the letter demanding an inspection also inferred that an eviction was imminent should the house not 'pass'. He is too depressed to tell him that, they all are. It's only well-wishers in their town that are keeping them going. They have just enough money to buy their home at the 'right-to-buy' discount price...thanks to their mother's will. This money will not get them anything else, obviously. Due to WEAVER VALE HOUSING TRUST admitting in correspondence today that they are again actively seeking to evict May's sons, I have prematurely had to submit the link to this and May's petition to them. The letter is too long to print here so I have emailed it to you.
Thank you to everyone who supported this petition and I would love to tell you that everything worked out and there was a happy ending. It didn't and it hasn't. Weaver Vale Housing Trust are determined to turn May's sons out of the property and have continued to hound them. Due to fund-raising by the public and any money the sons had they have hired a solicitor who has, so far, failed to win the right for the sons to continue with the 'right-to-buy' request that May started. The solicitor is now asking for more money before she carries on. I think it's time that public support took over and we demanded the right to allow May's sons to use their inheritance to buy the house their mother started to buy and which resulted in the hounding of the family and May's death in a Travelodge.
