Color Obstacle Rush should issue refunds for Cancelled Events
Ensure Color Obstacle Rush adhere to the Government guidelines regarding refunds for cancelled 2020 (Updated to add some 2021) events.
Why is this important?
During 2020 & 21 the Color Obstacle Rush had a number of events happening all over the UK, with tens of thousands of participants (Many for charity) attending. Each had paid an entry fee (usually around £40).
In March 20, this obviously changed as the whole world went into a global pandemic. Many of us kept in constant contact with events like this (especially those of us who were part of teams, fundraising for small charities / community groups).
The Color Obstacle Rush, after many emails, social media questions and multiple linked in messages finally (a week before our event in June 20) confirmed they had cancelled the events for the year. Many (like ours) were were very last minute and the announcement made only a few days before the event was due to take place.
The government had already announced events that had to be cancelled due to Lockdown were obligated to refund tickets, so we were confident that the charities (& also personal runners) would be refunded. However after dozens more emails, Color obstacle Rush announced their "policy" meant all tickets were non-refundable.
In July however, changes by the government came into effect as many people were being left out-of-pocket (not only because of this event company but others). They stated that in relation to non-refundable tickets (sic) "in the CMA’s view, the above rights to a refund will usually apply even where the consumer has paid what the business says is a non-refundable deposit or advance payment. The CMA also considers that businesses should not charge an admin fee (or equivalent) for processing refunds in the above circumstances."
Despite this clear instruction, customers have been told they will not be getting a refund as it is stated in The Color Obstacle Rush's T&C's, in fact a bulk email went out to all runners (in July 20) stating the runners must take part next year, despite rescheduled dates not being provided and the fact that many charities and individuals need their money refunded now.
The company has not communicated with the runners who are booked at any of the 2020 events personally despite people contacting them via all forms of communication, including contacting the CEO and employees with no response.
* I have updated this petition to include ALL runners from 2020 & 21 who have been left with no event & no refund....
The company has ignored emails / social media posts (blocking many of us).
The company insists on sending out blanket, copy & paste emails to everyone with teh same info on & with no recourse.
There is no option now but to create an easy to share / join and follow petition.
We are not wanting to cause any issues to the company during this economically challenging time but they have to respect that for many cases, like mine, there are charities and community groups who are waiting on entry fee refunds, runners and their friends who are waiting on refunds and there are clearly (thanks to Facebook and other social media platforms) individuals all across the country (from all events) who are impacted by the current situation, who are struggling to pay bills and that we are simply needing the refund money to make ends meet.
